Developer sees "bright future" for Dyer Mountain

An official from Dyer Mountain Associates said the company is working with investors who may step forward in the next few weeks and save the embattled project from bankruptcy.
Sara Duryea, DMA co-manager and one of the people officially in charge of the 6,700-acre, four-season resort project near Westwood, said it would be inappropriate at this time to reveal any details about new investors interested in the project.
"We're currently under the protection of the federal bankruptcy court," Duryea said. "We have until the end of September to file a plan with the court to satisfy our creditors and move out of Chapter 11. We're meeting weekly with new interested parties. We expect there will be a bright future for the project."
According to Duryea, the new investors are in a "due diligence period" and there won't be anything conclusive to report to the public until DMA files its financial plans with the court in mid-September.
She said DMA was still in possession of the property, and many aspects of a possible deal with new investors remain unresolved.
When DMA filed for Chapter 11 bankruptcy protection in federal court in San Francisco Thursday, March 27, it raised a number of issues for Lassen County.
DMA owes Lassen County $200,000 in back taxes.
Litigation surrounding the proposed project continues - especially the challenge to the developer agreement filed last October by the Mountain Meadows Conservancy, Sierra Watch and the Chico-based Yahi Group of the Sierra Club.
The suit, filed in Lassen County Superior Court, claims the county did not follow California environmental law in certifying the project's Environmental Impact Report, development agreement and tentative parcel map for the resort.
An amendment, filed Tuesday, Jan. 8, alleges the development agreement violates a voter-approved 2000 initiative, which zoned the area around Dyer Mountain and Walker Lake as a mountain resort.
The three groups allege the initiative gave the county the option of changing the land-use designation on the project site if construction of ski facilities had not commenced within seven years.
The suit initially asked the court to set aside the Board of Supervisors' certification of the EIR, development agreement and parcel map.
The three groups also seek an order directing the county to comply with the California Environmental Quality Act, a temporary stay and restraining order, and preliminary and permanent injunctions stopping the county and its agents from taking any action to implement the project until full compliance with CEQA.
Two-thirds of Westwood voters and almost 63 percent of voters countywide supported a November 2000 ballot initiative that amended the General Plan, zoning ordinance and Westwood Area Plan to allow the development of the resort.

At least one Dyer Mountain Associates manager put a positive spin on the company's filing for Chapter 11 protection in a federal bankruptcy court Thursday, March 27.

The Chapter 11 process allows DMA to propose to the court a reorganization plan to satisfy its debts. The court must approve this plan before it can be implemented.

Sara Duryea, one of three DMA managers, said the bankruptcy filing gives the company "time to get a deal done. Within 30 days we should have a pretty good idea of whom we're going to be working with. We've got 90 to 120 days to present a plan to the court."

According to Duryea, DMA has "two investors working with us right now, and we're talking with other interested investors. Dyer Mountain is an incredible asset, and there's lots of interest."

Duryea said she is very optimistic despite all the current debt in the housing market. She acknowledged the project "needs equity," but she said she was "very confident" DMA would partner with other investors during the Chapter 11 process who would eventually build the project.

She also said the bankruptcy filing would give the company some time to resolve its conflicts with lenders who have been seeking to foreclose on the property.

Earlier this month, California Mortgage Reality, DMA's mortgage lender, planned several public auctions so the remaining unpaid balance on a deed of trust executed Nov. 18, 2005, could be paid. DMA reportedly owes almost $16 million. CMR extended the deadline at each of those public auctions, held on the steps of the Lassen County Courthouse.

Calls to CMR requesting comment for this story on the DMA bankruptcy filing were not returned.

The Dyer Mountain project has been in the works at least since voters approved a ballot initiative in 2000, which zoned the area around Dyer Mountain and Walker Lake, also known as Mountain Meadows Reservoir, as a mountain resort.

The Lassen County Board of Supervisors approved the environmental impact report, development agreement and tentative parcel map for the resort in September 2007.

A month later, three groups filed suit to stop the resort development, claiming Lassen County did not comply with California environmental law in approving DMA's plans to build, or have other developers build, three golf courses, ski runs, more than 4,000 houses and condos, and commercial and retail projects.

Mountain Meadows Conservancy, Sierra Watch and the Chico-based Yahi Group of the Sierra Club filed the lawsuit in Lassen County Superior Court asking the court to set aside certification of the environmental impact report, development agreement and parcel map.

Attorneys on both sides are collecting material for the "administrative record" in the lawsuit, and trial dates have not been set yet.

The owners of a timbered mountainside proposed for a $35 million four-season resort have filed for bankruptcy protection.

Dyer Mountain Associates filed for protection under Chapter 11 of the federal bankruptcy code to gain more time to raise $15.8 million to stave off foreclosure of the resort property, said Grant Sedgwick, a manager of the company.

The developers have been under the threat of losing their 6,700 acres in Lassen County since November, when California Mortgage and Realty Inc. posted a notice of a foreclosure sale to recoup the money it loaned them.

The Dyer group also owes around $197,400 in back taxes to Lassen County.

"Our finances are obviously in a bit of a mess," Sedgwick said Tuesday.

The controversial ski and second-home resort on Dyer Mountain near Westwood has been planned since 2000, when voters countywide overwhelmingly approved zone changes allowing construction of around 1,000 houses.

Since then the development has grown to include more than 4,000 residential units, two golf courses and a ski resort projected to generate up to 500,000 visitors a year.

After the election, Briar Tazuk, a major investor in the resort and its primary promoter, told county officials construction would start in 2001.

But the developers encountered financial hurdles that delayed approval of the project by Lassen County officials. Among them was a 2004 dispute over their failure to pay a one-time tax payment of $157,000.

The project achieved a major milestone in September, when the Lassen County Board of Supervisors certified a state-required study of its environmental impacts. Sedgwick, who was hired in May as president, said the supervisors' approval freed the developers to seek about $100 million in financing to pay their debts to California Mortgage and Realty and carry the project into the future.

The search for investors has been complicated by foreclosure sales scheduled four times since November.

Each time the San Francisco-based lender has postponed the sale to allow the developers time to come up with the $15.8 million they owe it.

The final deadline was March 27, Sedgwick said. Instead of producing the money, Dyer Mountain Associates filed for protection in the federal bankruptcy court in San Francisco.

"We needed more time. This was a way to get it," Sedgwick said.

The developers have up to 120 days to submit a reorganization plan. They are scheduled to meet with their creditors in May, according to the filing papers.

That will include Lassen County, which will be involved to recoup the back taxes the Dyer developers owe, said Tax Collector Richard Egan. Annual taxes on the company's approximately 30 parcels are around $250,000. They increase to $276,000 with penalties if they are unpaid, he said.

Lassen County is also involved in the bankruptcy proceedings through an agreement with the developers that commits them to paying the county's legal fees in a lawsuit filed in October by three environmental groups.

The litigation is ongoing despite the bankruptcy filing, said Steve Robinson, director of the Westwood-based Mountain Meadows Conservancy, one of the plaintiffs. The filing verifies his belief that the developers "don't have the means to do this project," he said.

The Chapter 11 filing offers an opportunity to recognize the importance of Dyer Mountain and its natural resources, said Tom Mooers, executive director of Sierra Watch, also a plaintiff in the lawsuit. He said he hopes conservation groups will acquire the resort property to permanently protect the area.

Meanwhile, the developers are in "serious negotiations" with two potential investors to raise the money they need to both pay their debts and finance project construction, said Sedgwick. "Strange as it may seem," filing for bankruptcy protection could make that process easier, he said.

Guidelines established by the bankruptcy court will establish "a cleaner path to closing a transaction," said Sedgwick.

For now, however, financial difficulties have postponed construction on the project.

None of the engineering that should have been going on this winter has started, said Sedgwick, who resigned as company president last week but continues to serve as a manager.

He remained optimistic about the resort's future. "The current owners may not be involved in it, but this project will get built," Sedgwick said.

Lake Almanor Country Club

One of the popular areas to live in the Lake Almanor area is the Lake Almanor Country Club (LACC). Commonly called "The Peninsula" because of its shape, it's home to about 1200 residences. A good portion of these homes are vacation-2nd homes. It is a gated community, has security, and a home owner's association costing $1039 for 2008.

Amenities include a 9 hole golf course costing $26 for members, $34 for guests, and $38 for non-guests. There are tennis courts, two boat launching facilities, a swimming area, and a park with barbecue pits and picnic tables. There is an amphitheater at the park where summer concerts are held.

There are several lake front homes that rim the peninsula. Prices for lake front homes range from $950,000 to $2,000,000 or higher. Many come with docks allowing easy access for boating or fishing. Prices in LACC generally range from $300's to $900's. Many homes have lake views.

LACC being a relatively small area allows everyone to get to any activity in less than 10 minutes.

Mountain Biking, Kayaking & Fishing at Round Valley Reservoir

Looking for a quiet but easy to reach location for some wonderful biking or water activities? Then you will enjoy a visit to Round Valley Reservoir. Located a few miles from Greenville, Ca. this small lake is surrounded by large pines at an elevation of 4600 feet. Boating is permitted for motors 7.5 horsepower or less. Swimming, jet skiing, and water skiing are not permitted. The shoreline is less than two miles and makes for great paddling in a kayak. I've ridden my mountain bike around the perimeter. There is a packed dirt forest road around the lake. It is level, scenic, and, hard to get lost. This lake is for warm water fish species. Fish found within the lake are Bluegill, Large Mouth Bass, and Bullhead Catfish.

There is a Forest Service picnic area with tables and restrooms on the northeast side of the lake.

Directions: Greenville is located on Highway 89 between Chester and Quincy. If you approach Greenville from the south, turn left on Hideaway Road which changes into Round Valley Road. If you approach Greenville from the north, turn right onto Main St. When the road forks, stay to the left. Turn Right on Round Valley Road. Whichever way you come, it's about 4 miles from Highway 89 to reach the lake. It is a paved road to the lake. The lake is open all year. But, in winter there is lots of snow and most likely it becomes inaccessible for the winter months.

The Peninsula Firemen’s Association (PFA) has some big events scheduled for this spring and summer.

First up is the PANCAKE BREAKFAST on May 25th, from 7:00am to 12 noon at Firehouse #2. It’s “all you can eat” and the price is right at $7 per adult and $3 for kids.

The next event is the annual STEAK BBQ & COUPLES GOLF on June 8th, at Rec 1, with dinner beginning at 6:00pm. Tickets for the BBQ will go on sale after the Pancake Breakfast. Golf is optional and, for those who want to play, look for the sign up sheets in the Clubhouse – it’s a “lovey-dovey” format and usually starts at 3:00pm. Any of our non-LACC members who are interested in golf are welcome to participate.

Finally we have the annual CHICKEN BBQ on July 8th, at Rec 1, with dinner beginning at 6:00pm. Tickets for this BBQ will go on sale after the Steak BBQ. This BBQ includes our annual membership meeting (when dues are due!). We hope all the PFA members and any interested newcomers will attend.

The PFA is an organization that raises money in support of our local Firemen. Any adult male living within the Peninsula Fire District is eligible to join. In addition to the fellowship and rewards of supporting a good cause, membership in PFA allows you to join the Air Ambulance Insurance Program. Meetings and dinner are held on the 2nd Tuesday of the month at Firehouse #2, beginning at 6:00pm. Schedule dates are: April 8; May 13; August 12; September 9; October 14; November 11; and, December 9.

My wife and I moved to Lake Almanor because we love living in an area as beautiful as Lake Tahoe but without the congestion and high cost of living.

My journey to Lake Almanor was based upon my life long desire to live in the mountains. Because I needed to eat on a regular basis, after graduating from law school at USF in 1974, I gravitated to a more populated area and moved to Napa. I was a prosecuting attorney for 10 years with the Napa DA's office trying hundreds of cases from DUIs to serious felonies. Then in 1986 I was fortunate to become appointed as Napa Municipal Court's first Court Commissioner. I mostly presided over criminal cases, but did small claims and traffic court. I retired as a Superior Court Commissioner in 2000.

I'm sure several of my friends questioned my leaving at a young age. Many believing I would be bored. We moved to Nevada City thinking this would be our ideal retirement area. While enjoying many facets of the area, it wasn't until we visited Lake Almanor in 2002 that I realized this was exactly the kind of area that was for me. Luckily I had a wife who also enjoyed the outdoors and was willing to make another move. In 2004 we built a home and moved in just before Thanksgiving.

In 2002 I obtained my real estate license because it was a way to utilize my background and experience in the law, still give me flexible hours to enjoy my free time, and to keep my mind active.

Our home was built in the Bailey Creek Development. It seemed natural to work for the Bailey Creek Properties Real Estate office. It has turned out to be a wonderful situation as I thoroughly enjoy everyone associated with the office and all the clients I've had the privilege to work for.

Without the crowds and everything within a short distance we have our choice of several lakes to kayak in (or fish), mountains to hike, mountain bike, snow shoe and cross-country ski, and of course the three beautiful golf courses surrounding Lake Almanor. Lake Almanor is fairly warm in summer with water temperatures around 70 degrees. You can tell by the list of activities that we do get snow in the winter. Every winter is different, but typically, by early April the snow is disappearing quickly. Then comes the summer where temperatures average mid 40's in the morning to mid 80's in the afternoon. No humidity and hardly any mosquito's, at least where I live!

Downhill Skiing, Ice Fishing, Hunting

DOWNHILL SKIING
Stover Mountain is not open for the 2008 season. Stover Mountain Ski Area near Chester offers eight runs ranging from advanced to beginner, accessed by rope tow. Base elevation is 5,100 feet, and the runs are approximately 800 feet long. Open Saturdays and Sundays, snowboarders welcome. Rates are $10 per day for all ages. ICE FISHING
There are several lakes in the immediate vicinity for the less strenuous but just as exciting sport of ice fishing. Just check with the forest service or any fisherman.

HUNTING

Guided Snowshoe Hikes led by rangers are held each Saturday from early January to early April in Lassen Park. Normally the snowshoe hikes are offered at the southwest entrance but due to construction this season the hikes will be offered at Manzanita Lake. Meet the ranger for an approximate two-hour hike spanning one to two miles at 7,000-feet elevation. The walks will be offered twice daily on Saturday and Sundays from December 22 through March 16. Meet the park ranger at the Loomis Ranger Station at 10:30 a.m. or 1:30 p.m. Participants will be provided with snowshoes, but must wear boots, dress warmly and be at least 8 years old. Donation is $1. Call for details and reservations at 530-595-4444.Winter Snowshoe Walks are offered to the public on Fridays by the Almanor Ranger District. Snowmobile tours are provided by Majors Outpost near Lake Almanor(530-251-7512) and winter ATV tours by High Sierra ATV Tours near Frenchman's Lake. No other snowmobile rental services are available in Plumas County. The nearest rental service is Eagle Ridge Outfitters on Highway 89 about 30 minutes north of Graeagle.

December to April. Depending on snow, trails and snow-parks are open and available at Bucks Lake, La Porte, Lake Davis, the Lakes Basin Recreation Area, and the Lake Almanor Basin near Chester.
Hundreds of miles of groomed snowmobile routes are maintained throughout the winter season. Grooming efforts sponsored through California State Off Highway Vehicle funds. These trails are maintained for snowmobile use only. Use by ATV’s and all other wheeled vehicles is discouraged.
Bucks Lake has three staging areas open during the season – Big Creek, Bucks Lake Summit, and Four Trees. La Porte has a staging area with a warming hut and restrooms and four trailside warming huts. The Chester-Lake Almanor area boasts five staging areas – Chester-Lake Almanor Snowmobile Park, Swain Mountain, Morgan Summit, Jonesville and Fredonyer. The Lakes Basin Recreation Area south of Graeagle has the Gold Lake Staging Area five miles south of Highway 89 on Gold Lake Highway. Dyer sale postponed until April 8

Once again, Dyer Mountain Associates avoided the sale of the 6,700-acre four-season resort property in Westwood.
California Mortgage Realty, DMA’s mortgage lender, postponed the public auction at the Lassen County Courthouse of the Dyer Mountain Resort property for almost a month.
Independent auctioneer George Wickman read a notice of postponement at 2 p.m. on Friday, Feb. 22 in the lobby of the Lassen County Courthouse.
The lender planned the public auction to pay the remaining unpaid balance, estimated at $15,810,084.31, on a Deed of Trust executed on Nov. 18, 2005, when DMA purchased the property.
“We have until March 15, that’s the deal,” said Sara Duryea, one of three Dyer Mountain Associates managers. “We’ve met the criteria. We had to pay $200,000 by last Friday (Feb. 15). We did pay it.”
DMA President Grant Sedgewick said the sale will be postponed again to Tuesday, April 8. By that time, he said DMA will probably announce a new financing package providing enough money to pay off the loan DMA took out to buy the resort property and provide funds to go forward with the development.
“We’re getting some cooperation from our existing lender,” said Sedgewick. “They’re going to postpone it again. It’s going to be postponed until March 31. We have to demonstrate some progress to the lender and there are payments being made to the lender.
”Duryea said DMA is getting closer to announcing a refinancing deal. “We won’t make an announcement until we actually have closed a contract and we have a letter of intent,” she said.
Sedgewick agreed. “We are going to successfully refinance the project before any sale is necessary by the lender and we are cooperating and they are cooperating to make that happen,” he said. “We have an overall agreement that’s going to allow us to refinance but there are performance goals we have to meet along the way.
”The project has been in the works at least since voters approved a ballot initiative in 2000, which zoned as mountain resort the area around Dyer Mountain and Walker Lake, also known as Mountain Meadows Reservoir.
The Lassen County Board of Supervisors approved the environmental impact report, development agreement and tentative parcel map for the resort in September 2007.
A month later, three groups filed suit to stop the resort development, claiming Lassen County did not comply with California environmental law in approving DMA’s plans to build, or have other developers build, three golf courses, ski runs, more than 4,000 houses and condos, and commercial and retail projects.
Mountain Meadows Conservancy, Sierra Watch and the Chico-based Yahi Group of the Sierra Club filed the lawsuit in Lassen County Superior Court asking the court to set aside certification of the EIR, development agreement and parcel map.

Although it may be hard to imagine fireworks and the lovely aromas from summer barbecues with the deep snow lying across the Lake Almanor Basin, many local service organizations are already fully involved in planning for the months ahead.

While members of the Chester Lions Club have begun to discuss their annual barbecue in the park, the ladies of Lions Jack Isbell and Cal Deurloo are well on their way with their own July 4 community endeavor.

What is their endeavor? This year, Rita Isbell and Carol Deurloo have taken on the responsibility for the organization and operation of the 36th annual July 4 Chester Art and Craft Show in the Chester Park.

This popular event has grown tremendously under the nurturing hands of Joan Sayre and sidekick Marilyn Quadrio.

Making the decision that 2007 would be her last year to organize the show, co-founder Joan Sayre passed the mantle to the Chester Lions Club and provided Isbell and Deurloo hands-on training during the operation of the show.

In 2008, the roles will be reversed as Isbell and Deurloo take on full operational responsibility of the show while mentors Sayre and Quadrio shadow the duo throughout the day.

One of the first tasks they completed is the application packet for the event.

“Timing is everything and one of the most important of our tasks is to let the community know that booth applications are available right now,” said Isbell.

She also said the Chester Lions Club has extended an open invitation for Northern California artists and craftspeople to display their work during the daylong show. “The application packets contain information about booth space, terms of space and the requirement to submit photographs representative of the work to be sold,” she said.

She said it was important that participants understand that the Chester Arts and Craft Show is juried.“All artwork must be original and of good quality; no commercially or mass-produced objects or imports are acceptable,” she said.She said the club must receive applications and the other entry requirements no later than May 1.

She said applications are available and may be picked up at the Lassen Gift Company, the Chester Library-Museum, at the Chester-Lake Almanor Chamber of Commerce or through the mail by writing to: Chester Lions Club, Attn: Jack Isbell, P.O. Box 467, Chester, CA 96020.

Dyer Mountain sale postponed

There was no trustee sale of the 6,700-acre Dyer Mountain resort property Monday, Feb. 4, Wednesday, Feb. 6, or Friday, Feb. 8.

Independent auctioneer George Wickman read a notice of postponement at 2 p.m. each day in the lobby or on the front steps of the Lassen County Courthouse. Wickman said the sale was postponed at the discretion of the trustee, California Mortgage and Realty, which lent developer Dyer Mountain Associates almost $16 million to buy the property in Westwood.

On Friday, Feb. 8, Wickman said the sale had been postponed until 2 p.m. Friday, Feb. 22, by mutual agreement.

DMA Manager Grant Sedgewick said the developer of the four-season resort successfully negotiated giving DMA 60 days to refinance the loan.

However, since the negotiations were conducted by e-mail, DMA's three managers hadn't signed the final documents postponing the sale.

"The documents are in draft form," Manager Sara Duryea said Tuesday, Feb. 5. "They're going to be signed Wednesday (Feb. 6).

"On Thursday morning, Duryea said the documents would be signed later that day or early Friday, Feb. 8.

A California Mortgage and Realty spokesman said the company doesn't discuss borrowers with outside parties.

A notice of trustee's sale, filed Jan. 10 in the Lassen County Clerk's office, stated that the mortgage company would sell the Dyer Mountain Resort property and all fixtures and equipment located on the property at 2 p.m., Feb. 4, at public auction, to the highest bidder.

"The lender agreed to postpone the planned trustees' sale for two months because we've shown them that we have a pretty good prospect for refinancing. We reached an agreement this afternoon," Sedgewick said at 4:30 p.m. Sunday, Feb. 3.

The lender planned the public auction to pay the remaining unpaid balance on a deed of trust executed Nov. 18, 2005, when DMA purchased the property.

According to the trustee sale notice, the total amount of the unpaid balance was estimated to be $15,810,084.31. The notice said premiums and interest may increase the amount prior to sale.

DMA managers announced they were in negotiations with a number of entities interested in refinancing after the mortgage company filed a notice of default and election to sell under deed of trust Aug. 27 with Lassen County. It warned DMA it had to repay more than $3.59 million in past due payments plus permitted costs and expenses.

"We have new financing we're working on," Sedgewick said Thursday, Jan. 17. "It's close to complete.

The resort faces a lawsuit filed in October by Mountain Meadows Conservancy, Sierra Watch and the Chico-based Yahi Group of the Sierra Club. It alleges county approval of the project violated the California Environmental Quality Act.

Lake Almanor snowmobiling report from the Chester Chamber

If you have an interest in motorized winter recreation, the Lassen’s snowmobile trails are hard to beat. The Forest offers six staging areas with parking lots, miles of groomed trails and warming huts: Ashpan, Morgan Summit, Jonesville, Swain Mountain, Fredonyer, and Bogard Rest Stop.

Eagle Lake Ranger District Information

Snowshoers:
On Sunday February 10th, there will be a snowshoe hill climb up Fredonyer Peak. Meet at the Fredonyer Snow Park (off Highway 36) at 10:00 a. m. This is an ambitious hill climb, especially in the deep snow.

Cross Country Skiers:
On February 7, 2008 the Bizz Johnson Trail for Skiers from Goumaz to Devils Corral was groomed. There is also a snowmobile trail from Devils Corral to the first tunnel.

Hat Creek Ranger District Information

As of 02/02/2008 55 miles of trail had been groomed, including A-1 through A-10 on the Ashpan system, and L-1 to L-2 in Latour. On 02/03, 45 miles of the lower loops were regroomed, and on 02/05, 30 miles between Ashpan and Latour, via Huckleberry and Cow Creek Cutter were completed prior to the groomer being sidelined for repairs.

Last weekend the system received an additional 12-24” of new snow on top of the existing 4 feet at the staging area, ranging up to the 12-14 feet holding at Latour. By 02/05, the snowpack had settled approximately 10-12 inches, resulting in greatly improved stability and grooming conditions. Minimal snowfall has been received since then. In general, the current snow depth and quality is the best in many years.

Directional signs and caution poles have been reset, and should be visible in most locations, but some remain buried. As always, please ride attentive to hidden hazards, and with respect for your fellow riders.

Please note: that the Shasta Co. Search and Rescue training exercises that were originally scheduled for the Ashpan area on Saturday and Sunday, Feburary 9 and 10, have been relocated to Hatchet Mt., and will no longer need to use a portion of the staging area.

The Lassen National Forest has many types of outdoor recreation. Call forest offices for more information on where you can operate your wheeled vehicle. Visitors are reminded that snowmobile traffic is not permitted in the Caribou Wilderness, Thousand Lakes Wilderness and in Lassen Volcanic National Park.

Lassen County has yet to file a response to the lawsuit Mountain Meadows Conservancy, Sierra Watch and the Chico-based Yahi Group of the Sierra Club filed in October, according to Rick Crabtree, the county’s special counsel for the Dyer Mountain project.The suit claimed Lassen County did not follow California environmental law in certifying the EIR, development agreement and tentative parcel map for the resort. An amendment, filed on Tuesday, Jan. 8, alleges the development agreement violates the voter-approved 2000 initiative, which zoned as mountain resort the area around Dyer Mountain and Walker Lake. The three groups allege the initiative gave the county the option of changing the land use designation on the project site if construction of ski facilities had not commenced within seven years. The suit initially asked the Lassen County Superior Court to set aside the board of supervisors’ certification of the EIR, development agreement and parcel map.The three groups also seek an order directing the county to comply with the California Environmental Quality Act, a temporary stay and restraining order, and preliminary and permanent injunctions stopping the county and its agents from taking any action to implement the project until full compliance with CEQA.The suit said the 6,741-acre ski area and golf resort on undeveloped land on the flanks of Dyer Mountain “would house at least 17,382 people, making it in essence a brand-new city, just miles from Westwood, a small community of about 2,000 people.”The large new population and unprecedented degree of construction in an undeveloped and sparsely populated area will lead to “a wide array of significant environmental impacts,” it said.
